This data protection declaration serves to inform the user about the type, scope and purpose of the collection and use of personal data by the responsible provider (Hermann GmbH & Co. KG, Lehrstr. 57, 78669 Wellendingen, e-mail: info@hermann-drehteile.de) on this website and about the rights to which they are entitled.

The legal basis of data protection is determined by the Basic Data Protection Regulation (DSGVO) of the European Union (EU). Any processing of personal data (e.g. name, address, e-mail address or telephone number of a person concerned) always takes place in accordance with these data protection regulations and the respective specific national regulations.

You can use our website without giving any personal data. If a data subject wishes to make use of our company's services via our website, it may be necessary to process personal data. If the processing of personal data is necessary and there is no legal basis for such processing, we always obtain the consent of the data subject.

We take the protection of your data seriously. For this reason, we take all appropriate measures to ensure the most complete protection possible for personal data processed via our website. However, despite all measures taken, data transmissions over the Internet can contain security gaps, so that one hundred percent protection cannot be guaranteed. Alternatively, you can also send us your data by other means of communication, e.g. by telephone or in writing to our postal address.

1. Definitions

Article 4 of the DSGVO contains special definitions, which are also the basis of this data protection declaration. The data protection declaration should be both easy to read and easy to understand for every user. In order to ensure this, we will explain some of the terms used in accordance with Art. 4 DSGVO below:

  • "personal data" means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more specific characteristics which express the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person;
  •  "processing" means any operation carried out with or without the aid of automated procedures or any such series of operations relating to personal data, such as the collection, collection, organisation, arrangement, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of provision, reconciliation or linking, restriction, erasure or destruction;
  • "Restriction of processing" means the marking of stored personal data with the aim of restricting their future processing;
  • "Profiling" means any automated processing of personal data consisting in the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to the work performance, economic situation, health, personal preferences, interests, reliability, behaviour, location or relocation of that natural person;
  • "pseudonymisation" means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that this additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person;
  • "controller" means the natural or legal person, authority, body, agency or other body which alone or jointly with others decides on the purposes and means of processing personal data; where the purposes and means of such processing are specified by Union law or the law of the Member States, the controller or certain criteria for his appointment may be laid down in accordance with Union law or the law of the Member States;
  • "recipient" means any natural or legal person, authority, institution or other body to which personal data is disclosed, whether or not it is a third party. However, authorities which may receive personal data under Union law or the law of the Member States under a particular investigation mandate shall not be considered recipients; the processing of such data by the said authorities shall be carried out in accordance with the applicable data protection rules in accordance with the purposes of the processing;
  • "third party" means any natural or legal person, authority, institution or other body other than the data subject, the data processor, the data processor and the persons authorised to process the personal data under the direct responsibility of the data processor or the data processor;
  • "data subject's consent' means any voluntary declaration of intent in the specific case, in an informed and unequivocal manner, in the form of a declaration or other clear affirmative act, which the data subject indicates that he/she agrees to the processing of personal data concerning him/her.

3. Collection and storage of personal data as well as type and purpose of their use
a) When visiting the website
You can use our website without disclosing your identity. When you visit our website, the browser on your device automatically sends information to the server on our website. This information is temporarily stored in a log file. The following information is recorded without your intervention and stored until it is automatically deleted:

 

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.
  • The mentioned data will be processed by us for the following purposes:
  • Ensuring a smooth connection of the website,
  • Ensuring comfortable use of our website,
  • evaluation of system security and stability as well as
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f DSGVO. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.


b) When using our contact form
You can contact us at any time using a form provided on our website. Your first and last name and a valid e-mail address are required so that we know who sent the request and can respond to it. Further information, such as your telephone number, may be provided voluntarily. It is your free decision whether you want to enter this data within the contact form.
The data will be processed for the purpose of contacting us in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO on the basis of your voluntary consent.
The personal data collected by us for the use of the contact form will be automatically deleted after your request has been processed.

c) For orders via our website
You can either place orders as a guest on our website without registering with us, or register as a customer in our shop for future orders. A registration has the advantage that in case of a future order you can log into our shop directly with your e-mail address and your password without having to re-enter your contact and shipping data.
Your personal data is entered into an input mask and transmitted to us and stored. If you place an order via our website, we collect the following data both in the case of a guest order and in the case of registration in the shop:
Title, first name, surname,
a valid e-mail address,

This data is collected,
to identify you as our customer;
to process, fulfill and process your order;
to correspond with you;
for invoicing;
for the handling of any existing liability claims, as well as the assertion of any claims against you;
to ensure the technical administration of our website;
to manage our customer data.
During the ordering process, you will be asked for your consent to the processing of this data.
The data will be processed upon your order and/or registration and is required pursuant to Art. 6 para. 1 sentence 1 lit. b DSGVO for the aforementioned purposes for the appropriate processing of your order and for the mutual fulfilment of obligations arising from the purchase contract.
The personal data collected by us for the processing of your order will be stored and subsequently deleted until expiry of the statutory obligation to store data, unless we are obliged to store data for a longer period due to tax and commercial law storage and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO.

4. Passing on of data
Your personal data will only be passed on by us to third parties to the service partners involved in the contract processing, such as the commissioned logistics company and the credit institution commissioned with payment matters. In the case of passing on your personal data to third parties, however, the scope of the transmitted data is limited to the necessary minimum.

When paying via PayPal, credit card via PayPal, direct debit via PayPal or "Purchase on account" via PayPal we pass your payment data on to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal"). PayPal reserves the right to carry out credit checks for the payment methods credit card via PayPal, direct debit via PayPal or "purchase on account" via PayPal. PayPal uses the result of the credit assessment with regard to the statistical probability of non-payment for the purpose of deciding on the provision of the respective payment method. The credit report can contain probability values (so-called score values). If score values are included in the result of the credit report, they are based on a scientifically recognised mathematical-statistical procedure. Your personal data will not be transmitted to third parties for purposes other than those mentioned above.
We will only pass on your personal data to third parties if:
you have given your express consent pursuant to Art. 6 para. 1 sentence 1 lit. a DSGVO,
the disclosure pursuant to Art. 6 para. 1 sentence 1 f DSGVO is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, and
this is legally permissible and is necessary for the processing of contractual relationships with you pursuant to Art. 6 para. 1 sentence 1 lit. b DSGVO.
In the course of the order process, you will be asked for your consent to pass on your data to third parties.

5. Use of cookies
We use cookies on our website to make visiting our website attractive and to enable the use of certain functions. These are small text files that your browser automatically creates and which are stored on your device (PC, laptop, tablet, smartphone, etc.) as soon as you visit our website. Information is stored in the cookie that results in each case in connection with the specifically used terminal device. However, this does not give us direct knowledge of your identity.
Most of the cookies we use are deleted from your hard disk at the end of the browser session (so-called session cookies). Other cookies remain on your computer and enable us to recognize your computer on your next visit (so-called long-term cookies). These cookies are used to greet you with your user name and spare you the need to re-enter your password or fill in forms with your data for subsequent orders. These cookies are automatically deleted after a defined period of time. Our partner companies are not permitted to collect, process or use personal data via our website using cookies.
You can influence the use of cookies. Most browsers have an option with which the storage of cookies is restricted or completely prevented. However, we would like to point out that the use and especially the comfort of use can be limited without cookies.
The data processed by cookies is required for the aforementioned purposes in order to protect our legitimate interests and those of third parties pursuant to Art. 6 Para. 1 S. 1 lit. f DSGVO.

 

6. Links to third party websites
We are not responsible for the content of the linked pages and expressly do not adopt the content of these pages as our own. For illegal, incorrect or incomplete contents as well as for damages, which result from the use or non-use of the information, alone the offerer of the web page, to which one referred, is responsible. The liability of the person who merely refers to the publication through a link is excluded. We are only responsible for external references if we have positive knowledge of them, i.e. also of any illegal or criminal content, and if it is technically possible and reasonable for us to prevent their use.

7. Analysis and tracking tools
We use various tracking tools on our website to enable the design and continuous optimisation of the website. The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 f DSGVO. On the other hand, we use such measures to statistically record the usage behaviour of our website and to evaluate it for the purpose of optimising our offer. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

a) Google Analytics 
For the purpose of demand-oriented design and continuous optimization of our pages, we use Google Analytics, a web analysis service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised user profiles are created and cookies (see section 5) are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • the operating system used,
  • Referrer URL (the previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the Internet for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymized so that an assignment is not possible (IP masking).
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our website.
You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en).
As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on the above link. An opt-out cookie is set to prevent future collection of your data when you visit our website. The opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.

b) Google Adwords Conversion Tracking
We also use Google Conversion Tracking to statistically record and evaluate the use of our website for the purpose of optimising it for you. Google Adwords will set a cookie (see paragraph 5) on your computer if you have accessed our website via a Google ad.
These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user has clicked on the ad and has been redirected to this page.
Each Adwords customer receives a different cookie. Cookies cannot therefore be traced via the websites of Adwords customers. The information collected using the conversion cookie is used to generate conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, you will not receive any information that personally identifies users.
If you do not wish to participate in the tracking process, you can also reject the setting of a cookie required for this - for example using a browser setting that generally deactivates the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser to block cookies from the "www.googleadservices.com" domain. 8. Social Media Plugins
We use social plugins of social networks (e.g. Facebook, Google+, Instagram) on our website on the basis of art. 6 par. 1 p. 1 lit. f DSGVO in order to make our company better known. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. Responsibility for data protection-compliant operation must be guaranteed by the respective provider. The integration of these plugins by us takes place in the way of the so-called two-click method around visitors of our web page in the best possible way to protect.

a) Facebook
Our website uses social media plugins from Facebook to personalize their use. For this we use the "LIKE" or "PART"-button. This is an offer from Facebook.
When you access a page of our website that contains such a plugin, your browser establishes a direct connection to the Facebook servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website.
By integrating the plugins, Facebook receives the information that your browser has called up the corresponding page of our website, even if you do not have a Facebook account or are not currently logged on to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there.
If you are logged in to Facebook, Facebook can directly associate your visit to our website with your Facebook account. If you interact with the plugins, for example by pressing the "LIKE" or "PART" button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information will also be made visible to everyone on Facebook.

b) Google "+1" button
Our website uses the "+1" button of the social network Google, which is operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043-1351, USA. The button is marked with "+1".
The "+1" button is an abbreviation for "that's pretty cool" or "look at that". The button is not used to record your visits to the web. 
If a website of our website contains the "+1" button, your internet browser will load this button from the Google server and display it. The website you visit on our website is automatically notified to the Google server. When you see a +1 button, Google does not permanently log your browsing history, but only for up to two weeks. 
Google keeps this data about your visit stored for this period for system maintenance and troubleshooting purposes. However, this data is not structured according to individual profiles, user names or URLs. This information is also not accessible to website publishers or advertisers. The use of this information is only for maintenance and troubleshooting in internal systems at Google. Google will not evaluate your visit to a page with a +1 button in any other way. 
There will be no further evaluation of your visit to a website of our website with a "+1" button.
Allocating +1 itself is a public process, so anyone who does a Google search or accesses content on the web that you give +1 can potentially see that you have given +1 to that content. Give +1 only if you are sure that you want to share this recommendation with the whole world.
A click on this +1 button serves as a recommendation for other users in Google's search results. You can publicly indicate that you like our website, that you agree with our website or that you can recommend our website. If you have registered for Google+ and are logged in, the +1 button turns blue with one click. In addition, +1 will be added to the +1 tab in your Google profile. On this tab you can manage your +1 and decide whether you want to make the +1 tab public. 
In order to store and make publicly available your +1 recommendation, Google uses your profile to collect information about the URL you recommend, your IP address and other browser-related information. If you cancel your +1, this information will be deleted. All +1 recommendations from you are listed on the +1 tab in your profile.

c) Instagram Social Plugins
Our website uses so-called Instagram plugins (" Plugins"), which are operated by Instagram LLC, 1601 Willow Road, Menlo Park, CA 94025, USA (" Instagram"). The plugins are marked with an Instagram logo, for example in the form of an "Instagram camera".

d) Use of YouTube plugins
We use the integration of videos via YouTube. YouTube is operated by YouTube LLC, 901 Cherry Avenue, San Bruno, CA 94066, USA (" YouTube"). YouTube is represented by Google Inc. based at 1600 Amphitheatre Parkway, Mountain View, CA 940431, USA.
On our websites we use plugins from YouTube. If you call up the websites of our Internet presence provided with such a plugin, a connection to the YouTube servers is established and the plugin is displayed in. The YouTube server receives information about which of our Internet pages you have visited. If you are logged in as a YouTube member, YouTube assigns this information to your personal user account. When using the plugin, such as clicking the city button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your YouTube account and other YouTube LLC. and Google Inc. accounts and deleting the company's cookies before using our website.

9. Rights of the persons concerned
You have the right:
to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by me, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
in accordance with Art. 16 DSGVO, to demand without delay the correction of incorrect or complete personal data stored by us;
to request the deletion of your personal data stored with us in accordance with Art. 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
in accordance with Art. 18 DSGVO, to restrict the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing in accordance with Art. 21 DSGVO;
in accordance with Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request its transfer to another person responsible;
in accordance with Art. 7 para. 3 DSGVO, to revoke your consent to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future and
to complain to a supervisory authority pursuant to Art. 77 DSGVO. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our company headquarters.
to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 f DSGVO and provided that there are reasons for this which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which we will implement without specifying a particular situation.

10. Data security
We use the most common SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. Usually this is a 256 bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form is indicated by the closed display of the key or lock symbol in the lower status bar of your browser.
We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
